DMCA (Digital Millennium Copyright Act) Policy

Introduction

InstaSleb LLC respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (DMCA). We have implemented this policy to address claims of copyright infringement involving user-generated content on the CelebPups platform and associated websites: celebpups.com, celebpup.com, and instasleb.biz.

By using our services, all users agree to comply with this DMCA Policy, along with our Copyright Policy, Privacy Policy, and Terms of Service.

 

1. Reporting Copyright Infringement (DMCA Notice)

If you believe that your copyrighted work has been infringed upon on the InstaSleb platform, please submit a DMCA Notice to our designated Copyright Agent through our support page at instasleb.biz.

Your DMCA Notice must contain the following:

  1. Identification of the copyrighted work that has allegedly been infringed. If multiple works are involved, provide a representative list of the works.

  2. Identification of the infringing material, including the location (e.g., URLs or platform links) where it appears, with information sufficient to permit InstaSleb LLC to locate the material.

  3. Your contact information, including your name, address, phone number, and email address.

  4. A statement of good faith belief that the material's use is not authorized by the copyright owner, its agent, or the law.

  5. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

  6. Your physical or electronic signature.

2. Counter Notification Procedure

If you believe that material you posted on the CelebPups platform was removed or disabled as a result of mistake or misidentification, you may submit a Counter Notification through our support portal at instasleb.biz.

Your Counter Notification must include the following information:

  1. Identification of the material that was removed or disabled, along with the location (e.g., URLs or platform links) where it appeared before removal.

  2. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled due to mistake or misidentification.

  3. Your name, address, phone number, and a statement that you:

    • Consent to the jurisdiction of the Federal District Court for the judicial district where your address is located (or the Eastern District of Virginia, if you are located outside the U.S.).

    • Agree to accept service of process from the person or entity that submitted the original DMCA notice.

  4. Your physical or electronic signature.

Upon receiving a valid Counter Notification, we may restore the material unless the original complainant files a legal action within 10 business days to prevent the reinstatement.

 

3. Repeat Infringer Policy

InstaSleb LLC takes copyright infringement seriously. We reserve the right to terminate user accounts that are deemed to be repeat infringers. A user may be classified as a repeat infringer if they have received multiple valid copyright infringement notices.

In addition to copyright violations, users may also be subject to account termination for animal welfare violations if content includes harm or distress to animals, as outlined in our Terms of Service.

 

4. Backup Copies and Data Retention

If content is removed due to a DMCA notice, backup copies of the material may remain on InstaSleb LLC’s servers for up to 90 days to comply with legal, auditing, and operational needs. These backup copies will not be accessible to the public and will be deleted permanently following the retention period.

 

5. Misrepresentation and Section 512(f) Liability

Under Section 512(f) of the DMCA, any person who knowingly submits false claims of copyright infringement may be held liable for damages, including legal fees and costs. InstaSleb LLC reserves the right to pursue legal remedies for fraudulent or abusive DMCA claims.

 

6. AI Voiceovers and Platform-Generated Content

The AI-generated voiceovers used in video challenges on CelebPups are the intellectual property of InstaSleb LLC or its licensors. Users are prohibited from reproducing, modifying, or distributing these voiceovers outside the platform without explicit permission. Violation of this restriction may result in account suspension or legal action.

 

7. Changes to this DMCA Policy

InstaSleb LLC reserves the right to modify or amend this DMCA Policy at any time. Changes will be posted on instasleb.biz, and we will notify users of significant changes via in-app notifications. Continued use of our services constitutes acceptance of any revised policy.

 

8. Governing Law and Dispute Resolution

This DMCA Policy is governed by the laws of the State of New Jersey, without regard to its conflict of law principles.

Arbitration for Copyright Disputes

All disputes relating to this DMCA Policy will be resolved through binding arbitration in Trenton, New Jersey, in accordance with the American Arbitration Association (AAA) rules. Class actions are prohibited, unless explicitly agreed upon by InstaSleb LLC.
